1)Medical Termination of Pregnancy Act 1971 was in news Today in the Editorial Section :

What is the Provision in the Law:- Medical Termination of Pregnancy Act 1971 bars abortion of the foetus has crossed 20 week mark.
An exception to law is made if a registered medical practitioner  certifies that the continued pregnancy is threat to the life of either mother or baby.

What is the recent issue / background because of which it was in news:- SC has turned down the plea of 10 year old rape victim for abortion based on medical report that it would endanger both the girl and her foetus.

Abortion in India in not a legal right, but in exceptional circumstances it is allowed solely at the discretion of doctor or medical board of a hospital.

Has Govt. tried to Change the Abortion Timeline ?:- Yes, An amendment to the Medical Termination of Pregnancy Bill 1971 was proposed in 2014 which extends bar from 20 weeks to 24 weeks.
The draft bill also allows for abortion beyond 24 weeks in case foetus suffers from substantial abnormalities.

Some Important Points From Editorial:=

  • The 20 week cap is somewhat arbitrary as foetal impairments get detected at ultrasound done between 18 to 22 weeks when the foetus is said to have been substantially developed.
  • The proposed amendment to the act has introduced the concept of substantial foetal abnormalities in which case the time period of pregnancy is irrelevant
  • Amendment also widens the scope who could carry out abortions by introducing term “registered health care provider” which included recognised practitioners of Ayurveda, Unani and Homeopathy.

There is a fear that the proposed amendment may lead to illegal sex selection and abortion rackets .
